Acceptance of the Terms of Service
These Terms of Service cover Coregarden, our website, and everything related to it (we call it all the "Services"). It's a legal agreement between you, the person using the Services ("user" or "users"), and us at Coregarden ("Company", "we", or "us"). These Terms govern how you can access and use what we offer. BY USING THE SERVICES, YOU AND YOUR PARENTS OR GUARDIANS (IF APPLICABLE) AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
Modifications to the Terms of Service and to the Services
We might update these Terms whenever we need to. Any changes go live the moment we post them. It's on you to check in on updates now and then. If you keep using the Services after changes are posted, that means you're accepting them. We can also modify, restrict, or shut down the Services or parts of it whenever we want. If that happens, we're not on the hook for it.
Use of the Services
We take your information seriously and use standard industry protections to keep it safe from loss and unauthorized access. Your account's security is up to you. Anyone who accesses the Services through your connection is your responsibility, and they need to follow these Terms too. Everything you tell us has to be accurate and current. Let us know right away if anything changes. Here's the thing about internet transmission: it's not completely secure. We do our best to protect your information, but we can't promise absolute security. You're taking the risk when you send anything our way. We're not responsible if someone gets around your privacy settings or security measures. You can't do any of this: (a) access content that wasn't meant for you; (b) break through security or authentication measures; (c) mess with service for other users or hosts; (d) reproduce packet headers; (e) disable network services; (f) use bots, spiders, or automatic devices to copy or monitor the Services; (g) introduce viruses, worms, logic bombs, or anything harmful; (h) launch denial-of-service attacks or similar disruptions; (i) interfere with how the Services normally work.
Account Set-up and Subscription Services
Some features need you to create an account with a username and password ("Login Credentials"). You have to be at least 18. You can also log in using Apple ID or Google account. Don't ever share your Login Credentials with anyone. You're responsible for whatever happens on your account. We can terminate it whenever we want, for any reason. Some features cost money ("Subscription"). You buy them through our website, the Apple App Store, or Google Play Store. A Subscription works across multiple devices. Certain content is only for people who pay. What you pay depends on the period you pick: one month, six months, or a year (each one is a "Subscription Period"). We can change the Fee with written notice, and it takes effect when your current period ends. Your Subscription renews automatically unless you cancel before it runs out. The renewal period matches what you originally signed up for. We charge your payment method automatically. If payment doesn't go through, you lose access to paid features. Cancel anytime and it stops at the end of your current period. On the website, go to "My Account" to cancel. If you subscribed through the App Store, use that service's subscription management. After you cancel, you keep access until your period ends, then it stops. No more charges after that.
Intellectual Property Rights and Ownership
Everything in the Services—all the content, features, and functionality (the "Services Content")—belongs to Coregarden. That includes information, software, text, graphics, photographs, video, audio, designs, and the way things are arranged. Copyright, trademark, and other intellectual property laws protect all of it. All the trademarks, logos, product names, designs, and slogans come from Coregarden or others. You can't use them without written permission. Using them without permission violates our rights and might break the law. You can use the Services for personal, non-commercial stuff only. Don't take off copyright or trademark notices. Don't modify, copy, distribute, make something new from, or download material without asking us first in writing. We do let you do these things though: Your device or browser can temporarily cache things; You can download and print reasonable copies for yourself, for personal use, as long as you keep the proprietary notices on them; You can share social media content the way those platforms allow. If you break these Terms, your right to use the Services goes away. You have to return or destroy any copies you made that violated the rules. You don't own anything in the Services or the Services Content. We keep all rights not mentioned here.
User Submissions and Conditions of Use
We don't ask for confidential or proprietary information through the Services. But if you send us materials, content, information, or ideas ("User Submissions"), you're saying they're yours originally, nobody else has rights to them, and you give up moral rights to them. You're giving Coregarden a non-exclusive, royalty-free, perpetual, worldwide license to reproduce, modify, publish, display, distribute, and use your User Submissions for anything without paying you or giving you credit. We can delete your User Submissions whenever we want. You're promising that what you submit won't: Break any law; Violate terms on any linked third-party site; Contain exploitive, obscene, harmful, threatening, abusive, harassing, hateful, sexually explicit, violent, inflammatory, or discriminatory material; Involve stalking, exploitation, or harm to minors or inappropriate exposure; Ask for personal information that's prohibited by law; Have false or misleading information; Make it look like we or someone else endorses something when we don't.
Enforcement, Suspension, and Termination
We have the right to: Do whatever we think is necessary about User Submissions, including when they violate these Terms; Take legal action, send information to law enforcement, or tell the people who were harmed; Shut down or suspend your access without warning for any reason, including violations. YOU WAIVE AND RELEASE COREGARDEN AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS FROM ANY CLAIMS ARISING FROM OUR ENFORCEMENT ACTIONS OR INVESTIGATIONS.
No Reliance
The Services Content is there for general information. It's not advice you should rely on. Get professional help before you do anything based on what's in the Services. We try to keep the Services Content up to date, but we don't guarantee it's accurate, complete, or current. Using it is on you. We're not responsible for how you use the Services.
Privacy
When you use the Services, you're okay with us collecting, using, and sharing your information the way our Privacy Policy says. If you don't like the Privacy Policy, you shouldn't use the Services.
Third-Party Websites
The Services might link to other sites. We're not saying anything about them and we're not responsible for what's on them or how you use them. You access them at your own risk and you're subject to their terms. You can link to our Services in a fair, legal way without damaging our reputation or making it seem like we have a relationship we don't actually have. Don't frame our Services on other sites though. We can take away linking permission without notice. You agree to stop any unauthorized framing right away.
Online Purchases
Third-party providers Shopify and Stripe handle all orders, subscriptions, and transactions on our site. They have their own terms and privacy policies that we're not responsible for. Check those out before you buy anything.
Copyright Complaints
Copyright infringement is something we take seriously. To report it, send a written notice that includes: (1) your signature or a signature from someone authorized to act for you; (2) what copyrighted work is involved; (3) where on our site the infringing material is; (4) how to reach you; (5) a statement saying you genuinely believe the use isn't authorized; (6) a statement under penalty of perjury that your information is correct and you own the copyright or are authorized to speak for whoever does. If you think a notice was filed by mistake, you can send a counter-notice with: (1) your signature; (2) which material got removed; (3) a statement under penalty of perjury that the removal was an error or misidentification; (4) your full name, email, address, and agreement that you'll accept service of process and jurisdiction in Ontario or your local federal district court. Send everything to the contact information at the end of these Terms.
Disclaimer of Warranties
USING THE SERVICES IS YOUR CHOICE AND YOUR RISK. THE SERVICES COME "AS IS" AND "AS AVAILABLE" WITH NO GUARANTEES, WHETHER EXPRESS OR IMPLIED, INCLUDING NO GUARANTEES ABOUT MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE'RE NOT MAKING ANY WARRANTY ABOUT COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, OR AVAILABILITY. WE'RE NOT SAYING THE SERVICES ARE ERROR-FREE, UNINTERRUPTED, VIRUS-FREE, OR THAT WE'LL FIX DEFECTS. WE CAN'T PROMISE THAT DOWNLOADED FILES ARE VIRUS-FREE. YOUR COMPUTER AND DATA SECURITY ARE YOUR RESPONSIBILITY. TO THE FULLEST EXTENT THE LAW ALLOWS, WE'RE NOT LIABLE FOR LOSS FROM DENIAL-OF-SERVICE, VIRUSES, WORMS, MALWARE, OR HARMFUL MATERIAL ON YOUR DEVICE OR DATA.
Limitation of Liability
WHERE THE LAW ALLOWS, WE AND OUR AFFILIATES ARE NOT LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, LOST PROFITS, LOST BUSINESS, LOST DATA, OR EMOTIONAL DISTRESS, WHETHER FROM BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES, EVEN IF WE TOLD YOU POSSIBLE DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM WON'T EXCEED WHAT YOU PAID US IN THE MONTH BEFORE THE CLAIM, WHERE THE LAW PERMITS.
Indemnification
You agree to defend, indemnify, and hold harmless Coregarden and our affiliates from claims, liabilities, damages, and costs (including legal fees) that come from your breach of these Terms or your use of the Services, including your User Submissions, third-party sites, and unauthorized use of Services Content.
Governing Law and Choice of Forum
These Terms are governed by Ontario law and Canadian federal law, without regard to conflict of law principles. Any lawsuit coming from these Terms will happen in Ontario courts. You agree to their exclusive jurisdiction and you're waiving any objections to venue. BY ACCEPTING THESE TERMS, YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION AGAINST COREGARDEN.
Waiver
If we don't use a right or we take our time doing it, that's not a waiver. Using a right partially doesn't stop us from using it more or using other rights.
Severability
If any term is invalid or unenforceable in any jurisdiction, that doesn't affect the other terms or what happens in other jurisdictions.
Entire Agreement
These Terms and our Privacy Policy make up the entire agreement about the Services. They replace everything else we've said or written about it before.
